1. Agreement to Terms
By engaging WC Worcester Concrete for services, you agree to these Terms of Service. These terms apply to all customers, both residential and commercial, and govern the relationship between you and our company. If you do not agree with these terms, please do not proceed with our services.
2. Services Provided
WC Worcester Concrete provides concrete installation, repair, and related services including driveways, patios, foundations, walkways, decorative concrete, and other concrete work. All services are provided by licensed and insured professionals. We reserve the right to refuse service for any reason, including projects outside our scope of expertise or geographic service area.
3. Estimates and Pricing
All estimates are provided in good faith based on site conditions observed at the time of inspection. Final pricing may vary if unexpected conditions are discovered during excavation or installation. We will notify you immediately of any changes and obtain your approval before proceeding with additional work. Prices are valid for 30 days from the date of estimate unless otherwise specified.
4. Payment Terms
Payment terms are specified in your service agreement. We typically require a deposit to schedule work, with the balance due upon completion. We accept cash, check, and major credit cards. If payment is not received according to the agreed terms, we reserve the right to place a lien on the property for the amount owed, plus any collection costs and legal fees.
5. Project Timeline
We provide estimated completion dates based on current conditions and our schedule. While we make every effort to complete work on time, project timelines may be affected by weather, material availability, or unforeseen circumstances. We are not liable for delays beyond our reasonable control. We will communicate any schedule changes as soon as possible.
6. Warranty and Guarantees
We stand behind our workmanship and provide warranties as specified in your service agreement. Warranties typically cover defects in workmanship but do not cover damage caused by improper use, lack of maintenance, natural disasters, or soil movement. Any warranty claims must be submitted in writing within the specified warranty period. We will inspect the issue and determine the appropriate remedy.
7. Customer Responsibilities
You are responsible for clearly marking any underground utilities before work begins. You must provide clear access to the work area and remove any obstacles that may interfere with the project. You agree to follow our care and maintenance instructions after installation to ensure the longevity of your concrete. Failure to properly maintain your concrete may void warranty coverage.
8. Changes and Modifications
If you wish to make changes to the project after work has begun, you must submit a written request. We will provide a revised estimate for any additional work or modifications. Changes may affect the project timeline and final cost. No changes will be made without your written approval of the revised terms.
9. Cancellation Policy
If you need to cancel a scheduled project, please notify us as soon as possible. Cancellations made less than 48 hours before the scheduled start date may result in forfeiture of your deposit. If work has already begun, you will be charged for materials purchased and labor completed up to the cancellation date.
10. Limitation of Liability
WC Worcester Concrete is not liable for indirect, incidental, or consequential damages arising from our services. Our total liability for any claim is limited to the amount you paid for the specific service in question. This limitation applies to the fullest extent permitted by law.
11. Dispute Resolution
If a dispute arises, we encourage you to contact us first to resolve the issue directly. If we cannot reach a resolution, both parties agree to attempt mediation before pursuing legal action. Any legal disputes will be resolved in the courts of Worcester County, Massachusetts, and these terms are governed by Massachusetts state law.
12. Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the new terms.
