1. Introduction and Acceptance

These Terms and Conditions govern your use of the WC Worcester Concrete website located at concreteworcester.com (the "Site") and any services provided by WC Worcester Concrete("Company," "we," "us," or "our"). By accessing the Site or contacting us to request services, you ("you" or "Client") agree to be bound by these Terms. If you do not agree, do not use the Site or engage our services.

2. Description of Services

WC Worcester Concrete provides concrete contracting services including but not limited to driveways, patios, walkways, steps, foundations, retaining walls, pool decks, parking lots, and associated concrete work in central Massachusetts and surrounding service areas. All services are performed subject to a separate written contract or written estimate accepted by both parties.

3. Estimates and Quotes

On-site estimates are provided at no charge and without obligation. An estimate fromWC Worcester Concrete is not a binding contract. A project does not commence and no obligation on our part arises until:

• A written estimate or contract is provided to the Client and signed or accepted in writing by the Client; and
• Any required deposit as stated in the estimate has been received by WC Worcester Concrete.

Estimates are valid for 30 days from the date of issuance unless otherwise stated. Material pricing and labor costs are subject to change and may require a revised estimate after 30 days.

4. Project Scheduling and Weather

Concrete work is weather-dependent. WC Worcester Concrete reserves the right to reschedule any project without penalty due to rain, extreme temperatures, frozen ground, or other weather conditions that would compromise concrete quality or worker safety. We will notify you as early as practicable in the event of a weather-related rescheduling. We are not liable for project delays caused by weather, material supply disruptions, permitting delays outside our control, or other circumstances beyond our reasonable control.

5. Client Responsibilities

You agree to:

• Provide accurate information about the property and project requirements at the time of estimate.
• Ensure the work area is reasonably accessible on the scheduled start date, including clearing vehicles, furniture, planters, and other obstructions.
• Notify us of any underground utilities, irrigation lines, electrical conduits, or other subsurface features in the work area before work begins.
• Obtain any required permits or approvals prior to the start of work, unless the written contract specifies that WC Worcester Concrete will obtain permits on your behalf.
• Keep children and pets out of the work area during active concrete work and for the recommended cure period as instructed by our crew.

6. Payment Terms

Payment terms are as specified in the written estimate or contract. Unless otherwise stated:

• A deposit is required before scheduling any project.
• The remaining balance is due upon completion of the project, before our crew leaves the property.
• Accepted payment methods include cash, check, and bank transfer. Credit card payments may incur an additional processing fee as stated in the estimate.
• Late payments are subject to interest at 1.5% per month (18% annually) on any outstanding balance not paid within 10 days of the due date.

7. Workmanship Warranty

WC Worcester Concrete warrants that all concrete work will be performed in a workmanlike manner and materially in accordance with the accepted estimate. Our workmanship warranty covers defects resulting from our installation for one year from the date of project completion. This warranty does not cover:

• Normal hairline cracking (up to 1/8" wide), which is inherent in concrete and is not a structural defect.
• Damage resulting from tree root intrusion, soil settlement, frost heave, flooding, vehicle overloading, or other conditions outside our control.
• Surface scaling or spalling caused by the application of de-icing salts.
• Damage caused by modifications made by the Client or third parties after project completion.
• Concrete surfaces that have not been properly sealed and maintained in accordance with our care instructions.

Material defects are subject to the manufacturer's warranty and are not covered under our workmanship warranty.

8. Limitation of Liability

To the maximum extent permitted by applicable law, WC Worcester Concrete's total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific project giving rise to the claim. We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of business opportunity, or any damages arising from delays, weather conditions, or circumstances outside our reasonable control.

9. Dispute Resolution

Any dispute arising from services provided by WC Worcester Concrete shall first be addressed through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue mediation. These Terms are governed by the laws of the Commonwealth of Massachusetts. Any litigation shall be brought in the courts of Worcester County, Massachusetts, and both parties consent to the jurisdiction of such courts.

10. Website Use

You agree to use the Site only for lawful purposes. You may not:

• Use the Site in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Site or its underlying infrastructure.
• Use automated tools to scrape, crawl, or aggregate content from the Site without our prior written permission.
• Use the Site to transmit any unsolicited communications, spam, or malicious content.

All content on the Site, including text, photographs, and graphics, is owned by or licensed to WC Worcester Concrete and may not be reproduced without written permission.

11. Indemnification

You agree to indemnify and hold harmless WC Worcester Concrete, its employees, subcontractors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misrepresentation of property conditions or ownership, or your failure to fulfill your responsibilities as described in Section 5.

12. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
